Terms & Conditions of Use

1.0 Introduction

Welcome, and thanks for using www.serveetcons.com (“The Portal”)! Serveetcons.com is a registered Trade Mark of Serveetcons Limited (Serveetcons).

When you (the Agent, End-user, Visitor) use The Portal, you agree to our Terms and Conditions of Use. So please take a few minutes to read through these Terms and Conditions below, as use of the Portal entails entering into a legally binding agreement.

This document (together with the documents referred to on it) constitutes the Terms and Conditions of Use ("Terms") of The Portal. This applies to all persons or parties, whether a visitor or a registered user such as a Service Provider, Agent (artisans, technicians, handymen, and professionals), and End User. By using The Portal you indicate that you accept these terms and that you agree to abide by them. If you do not agree to these terms, please refrain from using The Portal.

2.0 About Us

Serveetcons (We, Our, Us, Serveetcons.com, Serveetcons LTD) is a company whose core purpose is to contribute to growth in the culture of service delivery excellence in our communities. Our core objective is to use The Portal as a tool to enable end-users to submit requests and book services. The requested service will be thrown open to pre-selected qualified Agents who are registered on the Portal to submit quotations. The services will be rendered by the Agents on behalf of Serveetcons. In other words, the requested services will be provided by Serveetcons through experienced and trusted agents. The end-users will deal directly with and pay Serveetcons for the services rendered. Payment for services will be made upfront by the end-user and held by Serveetcons in an escrow account to be allocated and released to the Service providers only upon acceptance and confirmation of work completion by the end-user.

3.0 Accessing Our Portal

When you use The Portal, you are entering into a legal agreement that you agree to the Terms. It confirms that you also agree to our Privacy Policy which covers how we collect, use, share, and store your personal information.

You agree that by clicking “Join Now”, “Join Serveetcons”, “Sign Up”, or any similar registering, accessing, or using The Portal (including any related mobile apps, Serveetcons platforms, or any content or information provided on The Portal, you are entering into a legally binding agreement with us.

We reserve the right to withdraw or amend the services we provide on The Portal without notice. We will not be liable if for any reason The Portal is unavailable at any time or for any period.

If you choose, or you are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any person, or third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have knowingly or unknowingly failed to comply with any of the provisions of The terms or violated any law.

From time to time, we may, where necessary and for whatever reasons, restrict access to some parts of The Portal, or our entire Portal, to users who have or have not registered with us.

When using The Portal, you must comply with the provisions of our Acceptable Use Policy.

You are responsible for making all arrangements necessary for you to have access to The Portal. You are also responsible for ensuring that all persons who access The Portal through your internet connection or facility are aware of the Terms and that they comply with them.

Our registered service providers and agents are expected to periodically update their profiles and information on The Portal by uploading or providing relevant up-to-date and truthful information about themselves and their services and/or capabilities to Serveetcons.

4.0 Intellectual Property Rights

We are the owner and licensee of all intellectual property rights in The Portal and the information and material appearing on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved.

Materials from The Portal must not be reproduced in any medium without a license and our written permission. Registered users may be permitted in writing only to print off one copy, and may with written permission download extracts, of any page(s) from The Portal for their personal use as private individuals only. You must not republish in any medium, print, electronic or otherwise, or modify, any part of the data or any materials printed or downloaded by you in any way, and you must not use any illustrations, photographs, videos or audio sequences, or any graphics separately from any accompanying text.

We (or the identified contributors) must always be acknowledged as the authors of material on The Portal.

You must not use the materials or information on The Portal (or any parts thereof) for any commercial purposes without the prior written permission of Serveetcons and the owner/originator of the material/information.

If you print off, copy or download any part of The Portal in breach of these terms, your right to use The Portal shall cease immediately and you must, at our option, return or destroy any copies of the materials you may have made.

5.0 Viruses, Hacking, and Other Offences

You must not misuse The Portal by knowingly introducing viruses, trojans, worms, logic bombs, or any other material that is or may be malicious or technologically harmful. You must not attempt to gain unauthorized access to The Portal, the server on which our Portal is stored, or any server, computer, or database connected to The Portal. You must not attack The Portal via a denial-of-service attack or a distributed denial-of-service attack.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of The Portal or to your downloading of any material posted on it, or on any website linked to it.

6.0 Linking to The Portal

You may link to our home page upon permitted, provided you do so in a way that is fair, legal, true, right, safe, and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you and that is not approved and permitted by us.

The Portal must not be framed on or linked to any other site, nor may you create a link to any part of The Portal other than the home page. We reserve the right to withdraw or withhold linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy or any other of our standard documents, policies, and procedures. If you wish to make any use of material on our site other than that set out above, please address your request for approval to info@serveetcons.com.

7.0 Variations

We may revise these terms at any time by amending this page or document. You are expected to check this page from time to time to take notice of any changes we make or may have made, as they are binding on you at all times. Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere on The Portal and other specific agreements.

8.0 Disclaimer

Serveetcons shall endeavor to ensure that the information contained on this Portal (including any responses that we give to your requests for information or advice) is correct. However, commentaries and other materials posted on our Portal are not intended to amount to advice on which you should rely except as may be covered under specific additional agreements. In particular, where parties using the Portal upload information about themselves, images of their facilities, and their capabilities to the Portal, all this information amount to guidance only. Users are encouraged to confirm the source directly from Serveetcons before making any professional or financial commitment or decision. We, therefore, disclaim all liabilities and responsibilities arising from any reliance placed on any such information, by any person to the Portal, or by anyone who may be informed of any of its contents.

9.0 The Portal Changes Regularly

We aim to update The Portal regularly and may change the content, format, or look at any time if the need arises. We may suspend access to our site, or close it indefinitely also if the need arises. We shall also update the materials and information we post on The Platform from time to time and as the need arises.

10.0 Our Liability

The materials and information displayed on The Portal, except for those specifically displayed and provided by Serveetcons, are provided without any guarantees, conditions, or warranties as to their accuracy. To the extent permitted by law, we, our affiliates, directors, employees, and/or other representatives and third parties connected to us shall not be liable, whether in tort (including for negligence or breach of statutory duty), contract, or misrepresentation or otherwise for:

loss of profits; or

loss of business; or

depletion of goodwill and/or similar losses; or

loss of anticipated savings; or

loss of goods; or

loss of contract; or

loss of use; or

loss due to corruption of data or information; or

any special, indirect, consequential, or pure economic loss, costs, damages, charges, or expenses.

11.0 Parties Obligation

11.1 Our Obligation

It is a core Serveetcons’ obligation to provide, operate, and maintain an up-to-date functional web and app platform to enable meeting the Serveetcons mission or core purpose of enhancing trust and engendering service delivery excellence in Nigeria. Also, Serveetcons shall provide the following:

  • Facilitation and management support;
  • Dispute resolution between Agents and End-Users;
  • To ensure that value is maximized, we will pursue a program of continuous improvement of service delivery by our registered agents through training, coaching, facilitation, and continuous assessment program, which will include a review of service delivery and agent’s performance by end-user; and
  • Timely release of Agent’s money once job completion has been confirmed accepted by the user and within the agreed timeframe.

11.2 Agent’s Obligation

i. Serveetcons has the right to register, unregister, rate, promote, demote, de-categorize, suspend, blacklist any party,  individual, service provider, agent, visitor, or end-user using The Portal for reasons related to security, and lack of performance, integrity, and accountability, excellence, or poor performance of agreed services.

ii. Agent shall perform all awarded services to the highest expected standard as per the scope of services requested by end-user and quoted by Agent. Only upon work completion by Agent and acceptance and confirmation of work completion shall payment for the Agent be released. Agent hereby accepts that all work defects shall be corrected without delay at no additional cost to either the end-user or Serveetcons.

iii. In the case where there is a warranty, the service shall perform to the expected level of functionality excellence.

iv. The Agent shall provide two credible and qualified guarantors, prior to enlistment on the Portal and job allocation. One of the two guarantors shall be a responsible relative and the second shall be any other person, which may not necessarily be a relative of the Agent. Both guarantors shall be employees of a corporate organization of adequate seniority and in a managerial cadre or role equivalent to a minimum of grade level 8 public servant.

v. The Agent warrants that he or she shall not be involved or engage in theft or damage of equipment or property belonging to a third party or any party during any work assignment at an end user’s location. The agent also agrees that in case there is any case of damage or theft, the Agent shall be suspended, delisted, or dismissed from participation in further job quotation on the Portal. Also, the Agent shall be fully responsible for payment of any associated cost of the theft or damage. The agent also agrees that his or her rating will be adversely affected and in a worse case may be liable for litigation.

vi. The Agent confirms that there is no past, current, and there will be no future criminal record associated with his records. In case any of the above is the case, Serveetcons reserves the right to suspend, dismiss, or terminate the Agent’s participation in future jobs under Serveetcons.

vii. The Agent accepts and warrants that it is against the Serveetcons ethics and violation of contractual terms to engage in any dealings, commercial discussions, negotiations, payment, or cash collection or receipt from end-user pertaining to the service or any past, current, or future related or unrelated job with the end-user. The Agent accepts that in case any such event happens, the Agent’s registration shall be suspended or terminated forthwith.

viii. It is part of the Agent’s obligation to clean up the worksite during and after all services. The work site shall be kept clean at not worse than the condition it was before the start of the work. Any complaint concerning an Agent not properly cleaning up after his or her work shall be unacceptable and may lead to poor rating and suspension of registration and participation for further works through the Portal. 

ix. It is the Agent’s responsibility to report all incidents, disputes, and near-miss situations to Serveetcons. The Agent hereby agreed that it is unacceptable practice to conceal, hide, withhold, or impartially report any event that may affect Serveetcons’ reputation adversely. The Agents consent that disputes, incidents, and near misses, are opportunities to learn and improve the Serveetcons way of work.  Reporting all such events, therefore, are obligations that shall be taken seriously. Failure to report as appropriate may lead to suspension, dismissal, or termination of registration and participation.

x. The Agents shall not confront or display undue aggressive behavior towards the end-user or any third party at the work site during the work. Although the Agent is an independent entity, the Agent hereby confirms understanding of his/her role as a Serveetcons’ ambassador. The agent shall therefore not engage in any action or activity that may affect the reputation of Serveetcons adversely.

xi. The Agent hereby confirms his/her understanding that each party is independent and responsible for meeting its own Tax obligations. Serveetcons will not collect, pay, or report taxes on behalf of the Agents. The Agent shall therefore endeavor to meet its regulatory and fiscal responsibilities wholesome. 

x. The Agent shall endeavor to execute all assigned services. It is not acceptable for the Agent to fail to report to a worksite and to execute the needed service from start to finish as per the scope of work.

xi. If the Agent is unavailable to execute a service that had been assigned through the Portal, the Agent must as a necessity notify and report to Serveetcons appropriately with relevant verifiable reasons a minimum of four hours to the service planned start time.

The Agent hereby accepts that his/her registration may be suspended or terminated as a result of failure to report to a worksite and to complete the work as scoped and quoted at Serveetcons' sole discretion.

xii. The Agent hereby confirms his/her understanding that there is zero tolerance for Job Cancellation and Rejection after assignment. Efforts must be made by the Agent to ensure adequate capability and experience to quote for only jobs that they have adequate capacity to execute. An unacceptable level of job cancellation and rejection rate after assignment, which may potentially lead to administrative challenges that cost more time, money, and adverse reputation to Serveetcons may warrant or lead to suspension or termination of an Agent’s registration.

xiii. The Agent hereby confirms that the information declared and submitted to Serveetcons always shall be true, full, and complete in its entirety. Failure to declare complete, full, and truthful information always may lead to immediate termination of the contract, registration, and participation in all works.

xiv. The Agent hereby accepts that applying for jobs they lack adequate experience, competencies, capability, and or capacity is not acceptable and shall lead to immediate suspension or termination of their registration as this will lead to time-wasting due to job cancellation and rejection by the agent or rejection by the end-user thus eroding reputation of Serveetcons and trust and confidence of the end-user, which will affect business opportunities.

The agent hereby understands that quoting for jobs that are too far located from their base is not acceptable as this may lead to tardiness and cutting corners. Indulging in this may lead to job cancellation or reassignment, which has time and cost implications.

11.3 The End User’s obligation

i. The end-user shall provide at their own cost a smartphone or tablet, or computer with internet access and data coverage that will enable access to the Serveetcons app or web Platform.

ii. As part of the process of service request, the end-user shall endeavor to submit an accurate description of the scope of work of the desired service.

iii. The end-user shall make payment of the invoiced amount of the primary invoice at least five hours ahead of when they want the service kick-off and supplementary invoice immediately it is confirmed that there is a valid variation in scope of work due to inaccurate scope description or any other reasons thereof, if applicable, using valid payment instrument. Payment shall only be made on the Serveetcons platform, either via the mobile app, mobile web, or web using a computer.

iv. The user shall endeavor to be available or make appropriate arrangements of a responsible person with adequate authority to:

a)  Welcome the Agent to the worksite

b)  Confirm the Agent’s onsite assessment and confirmation of the scope and/or variation of the scope of work of the desired service.

c) Confirm and accept completion of work and review of the Agent and service generally.

iv. The End User accepts and warrants that it is against the Serveetcons ethics and violation of Terms and Conditions of Service to engage in any dealings, commercial discussions, negotiations, cash payment directly to the Agent in connection to the service or any past, current, or future related or unrelated job with the Agent. The End User accepts that in case any such event happens, the Agent’s registration shall be suspended or terminated forthwith. The End User needs to be aware that indulging in such activities may hinder the ability of Serveetcons to sustain the ability to create trust and accountability in the Service Industry in Nigeria.

v. The End User shall not confront or display undue aggressive behavior towards the Agent during the work. The end-user shall ensure that the Agent’s fundamental rights are also respected during the work and at the worksite.

vi. It is the End User’s responsibility to report all incidents, disputes, and near-miss situations to Serveetcons. The End User hereby agrees that it is unacceptable practice to conceal, hide, withhold, or impartially report any event that may affect Serveetcons’ reputation adversely. The End User consents that disputes, incidents, and near misses, are opportunities to learn and improve the Serveetcons way of work.  Reporting all such events therefore will be relevant contributions to the Serveetcons core purpose of enhancing trust and engendering service delivery excellence in Nigeria. 

12.0 Information About You and Your Visits to The Portal

We process information about you in accordance with our Privacy Policy. By using our Portal, you consent to such processing and you warrant that all data and information provided by you are accurate.

 13.0 Uploading Material to The Portal

Whenever you make use of a feature that allows you to upload material to the Portal, make contact with other users of the Portal, or ask questions, you hereby warrant that it shall comply with the standards set out in our Acceptable Use Policy. You warrant that where any such contribution does not comply with our policy, you indemnify us for any breach of that warranty.

Any material you upload to our Portal or make available to us in any other way will be considered non-confidential and non-proprietary, and by posting or uploading material to the Portal you grant us the right to use, copy, distribute and disclose to third parties any such material for any purpose. By submitting questions or queries you grant us the right to publish such questions or queries, together with any responses provided by us. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to the Portal constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Portal.

We have the right to remove any material or posting you make on the Portal if, in our opinion, such material does not comply with our Acceptable Use Policy or law. 

14.0 Linking from The Portal

The Portal includes links to external websites. These links are included to give you the opportunity to explore an opportunity in more depth. We have no control over the contents of those sites or resources and accept no responsibility for those sites or any loss or damage that may arise from your use of them.

15.0 Jurisdiction and Applicable Law

The Nigerian courts will have exclusive jurisdiction over any claim arising from or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms are governed by Nigerian law.

16.0 General Terms

If a court with authority over this Agreement finds any part of it not enforceable, we (you and us) agree that the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, we (you and us) agree to ask the court to remove that unenforceable part and still enforce the rest of this Agreement. To the extent allowed by law, this Agreement is binding.

If we do not act to enforce a breach of this Agreement, that does not mean that Serveetcons has waived its right to enforce this Agreement. You may not assign or transfer this Agreement (or your membership or use of Services) to anyone without our consent and written permission or approval. However, you agree that Serveetcons may assign this Agreement to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries of this Agreement.

We reserve the right to change the terms of this Agreement and will provide you notice if we do and you agree that changes cannot be retroactive. If you do not agree to these changes, you must stop using The Portal and there shall be no claims for direct, indirect, or consequential losses.

You agree that the only way to provide us with legal notice is at the registered address of Serveetcons Limited.
